18. Limitation of Liability
You expressly understand and agree that Local City Fun shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if Local City Fun has been advised of the possibility of such damages), resulting from: (i) the use or the liability to use the Local City Fun website or Services; (ii) the cost of procurement or substitute goods or services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the Local City Fun website or Services; (iii) unauthorized access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the Local City Fun website or Services; or (v) any other matter relating to the Local City Fun website or Services.
You expressly acknowledge that Local City Fun as entered into this agreement, and has and will make the Local City Fun website, Services and content available to you in reliance upon the limitations and exclusions of liability and the disclaimers set forth in these terms and conditions, and that the same form an essential basis of the bargain between you and Local City Fun.
You expressly agree that the limitations and exclusions of liability and the disclaimers set forth in these terms and conditions will survive, and continue to apply in the case of, fundamental breach or breaches, the failure of essential purpose of contract, the failure of any exclusive remedy or termination of this agreement.
